These Terms and Conditions ("Terms") constitute a legally binding agreement between Anchor Cleaning Services (ABN on file) ("Company", "we", "us", "our"), operating from Kalkallo, Victoria 3064, and any person or entity ("Client", "you", "your") who visits our website at anchorcleaningservices.com.au, submits an inquiry, requests a quote, or engages our services in any capacity.
1. Acceptance of Terms
1.1 Your access to and use of this website, submission of any inquiry form, or engagement of any service offered by Anchor Cleaning Services constitutes your full, unconditional, and irrevocable acceptance of these Terms, together with our Privacy Policy, which is incorporated herein by reference.
1.2 These Terms apply to all visitors, clients, prospective clients, and any other parties who interact with Anchor Cleaning Services, whether online or in person.
1.3 We reserve the right to amend, update, or replace these Terms at any time and without prior notice. Continued use of our website or services after any changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms regularly.
2. Services
2.1 Anchor Cleaning Services provides commercial cleaning and floor restoration services including, but not limited to: periodic cleaning, strip and seal floor restoration, high pressure cleaning, commercial glass cleaning, floor deep clean, and carpet steam cleaning.
2.2 All services are subject to availability and geographic scope. We operate primarily within Kalkallo and Greater Melbourne, Victoria. Service availability outside this area is at our sole discretion.
2.3 We reserve the right to refuse, modify, or discontinue any service offering at any time and without notice or liability.
2.4 Service descriptions on our website are provided for general informational purposes only and do not constitute a guarantee of specific outcomes, results, or standards unless expressly agreed in writing in a signed service agreement.
3. Quotes, Pricing & Payment
3.1 All quotes provided via our website, phone, or email are estimates only and are not binding unless confirmed in writing by an authorised representative of Anchor Cleaning Services.
3.2 Final pricing may vary from any estimate provided, based on the actual conditions of the premises, scope of work, access, travel, and materials required. The Client will be notified of any significant variation prior to commencement, where reasonably practicable.
3.3 Prices are subject to change without notice. GST applies to all services where applicable under Australian law.
3.4 Payment is due as specified in the invoice issued upon completion of services, unless otherwise agreed in writing. Accepted payment methods will be communicated at the time of service.
3.5 Late payments will attract interest at the rate of 10% per annum, calculated daily from the due date until the date of full payment. Anchor Cleaning Services further reserves the right to recover all costs of collection, including legal fees, on a full indemnity basis.
3.6 We reserve the right to withhold or suspend services for any Client with outstanding unpaid invoices.
4. Client Obligations
4.1 The Client must:
- Provide safe, unobstructed access to all areas requiring cleaning at the agreed time;
- Disclose the presence of any hazardous materials, chemicals, substances, or conditions on the premises prior to service commencement;
- Ensure all valuable, fragile, or sensitive items are secured or removed from service areas;
- Provide adequate utilities including water and electricity access where required for service delivery;
- Ensure the premises comply with all applicable work health and safety requirements.
4.2 Failure to comply with any Client obligation may result in cancellation of the service visit without refund, and the Client shall remain liable for any applicable cancellation or call-out fees.
4.3 The Client warrants that they are duly authorised to engage Anchor Cleaning Services for the premises specified and indemnifies Anchor Cleaning Services against any third-party claims arising from the Client's lack of authority.
5. Cancellation & Rescheduling
5.1 Cancellations or rescheduling requests must be made no less than 24 hours before the scheduled service commencement time.
5.2 Cancellations made with less than 24 hours notice may be subject to a cancellation fee of up to 50% of the quoted service value to compensate for loss of booking, labour allocation, and travel costs.
5.3 If our team attends a premises and is unable to access or commence work due to circumstances within the Client's control, a full call-out fee will be charged.
5.4 Anchor Cleaning Services reserves the right to cancel or reschedule services due to unforeseen circumstances including, but not limited to, equipment failure, staff illness, or force majeure events. In such cases, we will provide reasonable notice and offer rescheduling at the earliest available opportunity. No compensation will be payable for such cancellations.
6. Limitation of Liability
6.1 To the maximum extent permitted by applicable law, Anchor Cleaning Services' total liability to the Client for any claim arising out of or in connection with the provision of services (including negligence) shall be limited to the total fees paid by the Client for the specific service from which the claim arises.
6.2 Anchor Cleaning Services shall not be liable for:
- Any indirect, special, incidental, consequential, or punitive loss or damage;
- Loss of profit, revenue, business, contracts, or anticipated savings;
- Loss arising from pre-existing damage, wear and tear, or defects in the premises or flooring;
- Damage resulting from the Client's failure to disclose hazardous conditions or non-compliance with Client obligations;
- Loss of or damage to any items not secured or removed from the service area as required under Clause 4.1;
- Any loss arising from our reliance on inaccurate or incomplete information provided by the Client.
6.3 Nothing in these Terms shall exclude or limit liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law under applicable Australian consumer protection legislation.
6.4 The Client acknowledges that the services are commercial in nature and, to the extent permissible under the Australian Consumer Law, the statutory consumer guarantees relating to the supply of services do not apply.
7. Damage Claims
7.1 Any claim for damage allegedly caused by Anchor Cleaning Services must be reported in writing to admin@anchorcleaningservices.com.au within 48 hours of service completion. Claims made after this period will not be accepted.
7.2 We reserve the right to inspect any damage claimed before accepting liability. The Client must not undertake any remediation or engage third parties until we have had the opportunity to inspect.
7.3 Where a damage claim is accepted, our liability shall not exceed the cost of reasonable repair or, at our option, replacement with an item of equivalent value and age.
8. Dispute Resolution
8.1 In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the provision of services ("Dispute"), the parties must first attempt to resolve the Dispute by good faith negotiation.
8.2 If the Dispute is not resolved within 14 days of the aggrieved party's written notice to the other party, either party may refer the Dispute to a mutually agreed mediator under the Dispute Resolution Institute of Australasia (DRIA) rules, with the costs of mediation shared equally.
8.3 The parties agree that mediation is a condition precedent to commencing any court or tribunal proceedings. No legal proceedings may be initiated unless and until the mediation process has been exhausted or a mediator certifies that mediation has failed.
8.4 Notwithstanding the above, Anchor Cleaning Services reserves the right to seek urgent injunctive or interlocutory relief from a court of competent jurisdiction without first resorting to mediation.
8.5 These Terms and any Dispute shall be governed by and construed in accordance with the laws of the State of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria.
9. Intellectual Property
9.1 All content on this website, including but not limited to text, images, logos, graphics, videos, and code, is the intellectual property of Anchor Cleaning Services or its licensors and is protected by Australian and international copyright law.
9.2 You may not reproduce, distribute, modify, or use any content from this website for commercial purposes without our prior written consent.
10. Privacy
10.1 Your use of this website and our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

12. Force Majeure

13. Severability
13.1 If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
14. Entire Agreement
14.1 These Terms, together with the Privacy Policy and any written service agreement executed between the parties, constitute the entire agreement between you and Anchor Cleaning Services and supersede all prior representations, understandings, or agreements relating to the subject matter herein.
